Radiation Exposure Control Act, or RECA, is found under Public Law 101 – 426, enacted 15. October 1990; 42 U.S.C. 23 § 2210 et seq. While RECA claims are becoming fewer and fewer, new legislation is expected to make up the difference. Our services involve reconstructing historical radiation doses using available records, site data, and established dose assessment methodologies. We analyze employment histories, monitoring data, and operational conditions to provide credible estimates of occupational exposure. Where data gaps exist, we apply defensible assumptions and validated models consistent with recognized health physics practices.
Toepfer & Associates, PLLC provides expert forensic radiation dose reconstruction services to evaluate historical radiation exposures in occupational, environmental, and incident-specific contexts. We assist in identifying and characterizing NORM and TENORM through site assessments, sampling, and radiological analysis. Based on these findings, we develop tailored management strategies that address material handling, storage, transportation, and worker protection in accordance with applicable regulations and industry best practices. This often involves water treatment, concentration, and separation; new technologies like slurry ablation may also be applicable in certain situations. Our expertise includes evaluating treatment and disposal options, such as stabilization, containment, dilution, or transfer to licensed disposal facilities. We also support waste classification, packaging requirements, and coordination with approved treatment and disposal vendors.
Our services begin with a thorough review of the NOV, inspection reports, and supporting documentation to clearly understand the scope and basis of the violation. We conduct root cause analyses using structured methodologies to identify underlying issues in procedures, training, oversight, or operational controls. We assist in preparing clear, well-organized regulatory responses that address each finding, demonstrate accountability, and outline corrective actions in a manner aligned with agency expectations. Our team develops corrective action plans that are specific, measurable, and sustainable, helping prevent recurrence and improve overall program effectiveness. Toepfer & Associates also supports implementation, including procedure updates, training enhancements, and program improvements. We ensure that corrective actions are properly documented, tracked, and verified for completion, supporting audit readiness and future inspections. We also help define roles and responsibilities to ensure clear decision-making during emergencies.
Industrial & Specialty Applications
Nuclear density gauges are widely used in industrial applications. In some instances, their radioactive sources can be several millicuries (several megabecquerels). Handling density gauges is only for specially licensed individuals. Work should only be performed in the vicinity of these gauges by trained occupational radiation workers. We conduct comprehensive radiation surveys to evaluate dose rates, contamination potential, and safe operating conditions associated with nuclear density gauges. Using calibrated instrumentation and established health physics methods, we verify that equipment is functioning properly and that exposure levels remain within regulatory limits. Our detailed reviews include verification of applicable documentation, gauge accountability, leak test records, personnel dosimetry, radiation protection program policies and procedures, and license conditions.
Toepfer & Associates, PLLC supports medical, industrial, research, and security operations in maintaining safe, compliant, and efficient use of X-ray–producing equipment. Using established methodologies and existing guidance (e.g., NCRP 147, 149, the IAEA's Diagnostic Radiology Physics handbook, ICRP Publication 103, etc.) to evaluate exposure scenarios, we can design effective shielding, determine compliance with dose limits, perform kerma calculations, and assess compliance with applicable federal, state, and industry standards. Our analyses incorporate equipment characteristics, occupancy factors, workload assumptions, and facility layouts to produce accurate, defensible results. Using empirical data whenever appropriate, we clearly document assumptions, inputs, and uncertainties to support regulatory submittals and technical review.
