Defendants’ Rebuttal Expert | Confidential Client

Toxic tort claim whereby Plaintiffs’ alleged exposure to uranium and other toxic chemicals from a former uranium hexafluoride conversion facility. Plaintiffs’ complaint alleged incompetence, poorly trained workers, gross negligence, and the willful, deliberate, and unlawful discharges of carcinogenic pollutants to the air, groundwater, surface waterways, and soil, which allegedly contaminated the atmosphere, fish and aquatic ecosystems, vegetables used for human consumption, and beef cattle. Outcome: Summary judgment for the defense.

Technical Advisory Support in Anticipation of Litigation | Confidential Client, Montana

Supported leading scientific and engineering experts for a Superfund site in Montana requiring strict adherence to Whole Effluent Toxicity (WET) parameters; project involved ion-ratio-balancing of nutrients and aquatic monitoring. Served as a senior regulatory and technical advisor, helping the team position for a new Consent Decree. This involved a review of years of prior environmental studies and a thorough understanding of the CERCLA Remedial Investigation/ Feasibility Study (RI/FS) process as well as various National Pollutant Discharge Elimination System (NPDES) permits.

Technical Expert in Anticipation of Litigation | Confidential Client

Served as the chief point of contact and senior liaison between EPA and a technical team of health physicists and environmental scientists who were challenging a Human Health Risk Assessment (HHRA) conducted by EPA. This effort required a thorough understanding of EPA’s administrative and investigatory processes, including establishing and following Data Quality Objectives (DQOs).

[Potentially] Responsible Party’s Technical Advisor | Confidential Client

Supported inside and outside legal counsel in the successful negotiation of a Record of Decision (ROD) and Administrative Order on Consent (AOC) for site regulated under the Comprehensive Environmental Recovery, Compensation Liability Act (CERCLA) (aka, Superfund) listed on the National Priority List (NPL). ROD and AOC negotiations were based on Clean Water Act (CWA), Safe Drinking Water Act (SDWA), associated Water Quality Standards (WQSs), and applicable Maximum Concentration Limits (MCLs). Negotiations were further complicated because they involved liaising between federal and state agencies, local government officials, and opposing efforts undertaken by non-government organizations.
